As many of my friends are leaving this summer the question of severance pay keeps coming up. As we will leave at some point this year I am interested to know the facts. I understand if your helper has worked continuously for more than 2 years they are entitled to it if they are being made redundant. When I read the labour website their definition of this is if the job is no longer available. My question is what if you offer to take your helper home with you and she does not want to? Surely the job is therefore still available (especially if you do intend to get help when you return) and so in this case she has not been made redundant under the labour gov terms?
