Statutory holiday for helper over Xmas

Just wondering when they go on leave for Xmas?

24th-27th or the 25th-27th?

Thanks, Cara. I was going to give her extra days leave as a "gift" because I'm on leave but looks like, all the red dates are her statutory holidays anyway.

In December, only 22 or 25 (employer's choice) are statutory. January 1 is also statutory.


26 and 27 December, as well as 2 January, are not statutory. However they are general holidays. This means that you are not required to give your helper time on off these days. Many people do, however, including our family.


The postponement of 25 to 27 is a bit of a grey area regarding statutory status. The Labour dept simply lists 25 as statutory with no other mention, while GovHK notes that 27 is an additional general holiday since 25 is on a Sunday.
