We moved into our property in 2003 and initially signed a standard 12 month contract.
In 2004 we signed a new standard 24 month contract at the same property with ability to break the contract after 12 months with 2 month notice to the landlord.
We re-signed a new standard contract in 2006 for 24 months on the same basis i thought but the landlord is claiming we have signed for the full 24 months and may need to pay a penalty for moving out as we have only been staying in the property for 13 months of the latest contract.
Is this usually the case or do i still have the right to break the contract with 2 months notice?
Re-check your tenancy agreement very carefully - if it is 'fixed' for 24 months with no 'get out' clause then the landlord has legal right to make you pay for the full 24 months unless you can come to agreement for him to release you early - if you really want to move out you can offer a compensation of couple of months rent to him. Laws tend to be more protective of landlord than tenant. Good luck
