breaking the lease contract Posted by Bubas (283 days ago) We have a lease contract that lasts 14 months until end of next March. We would like to move and quit this flat before. How is it possible to break the contract before the expiry date ? They are within their rights to demand that you continue paying rent until the end of March, but some landlords are actually quite reasonable and will be helpful if you have a good enough reason. On a similar thread, someone advised offering to pay the agency fees to find a new tenant, which is a very good idea. If you help the landlord to find a tenant as much as you can, it's more likely that s/he will be helpful to you. (I am based in Hong Kong) Posted by associates (283 days ago) It depends mainly on the WORDING of the lease......whether you have a "break clause" in the lese agreement..depending always on the wording of the lease, if no break clause you can ASK the landlord for an agreement to terminate; IF the market has risen a greedy landlord will be more than happy to let you out WHEN they find a replacement tenant at a higher price!! If not then your alternative is to find a replacement tenant to take up the remainder of the term....the landlord would NOT be wise to resist this placement and if they did you could argue they caused their own lost rent if they chase after you....however, what does the lease say about restricting you finding a tenant? (I am based in Hong Kong) |
