My son overstayed for 8 months

Hello Guys,

My son 8 yrs old, was overstayed for 8 months now in hk. I overlook the year of his visa I thought that it will expire next year...just found out when I checked my children's passport co'z we are planning a vacation this coming xmas. I went to the immigration this morning and as expected the officer is quite angry and still telling me that he will prosecute my son. I knew that it was my responsibility that's why I'm wondering why the officer is keep telling me that he will prosecute my son.

Anyway, to make the story short the officer told me that no more next time and giving me a piece of paper and asking to come back to p-up the visa of my son. But, after I left a few minutes the officer call me and asking me to go back..he get back the paper that he gave me and telling me to wait for a letter from the immigration....so I'm quite confuse and feel nervous.

Any advise regarding this matter....thanks

Over-staying your visa is a very serious matter.

You, as a parent, have been irresponsible. Expect to be punished.

I know it's a serious matter that's why I'm asking others opinion about this.

Better prepare a very nice letter explaining your case and send the letter immediately as follow up to the Immigration with the reference no.

though it is a serious matter --they can do little to harm you .

just send a letter stating teh excat reason as you mentioned above- apologize to the immigration director for this oversight and all will be okay.

what nationality are you-- ??

Okay will do that....maybe sending them a letter will ease their anger..

Hoping that this will not give me big trouble...

What sort of visa was your son on? When was it issued? And what was the expiry date? And what sort of visa are you on, or are you a PR?

My son was born here in hk and his under dependant visa..I am a permanent resident of hk...his visa expired last feb2009.

Personally I think you shouldn't have too much of a problem as long as you spell it all out in a letter to Immigration, admit that you made the mistake, and beg for their understanding. Good luck.

The fact that they told you to wait for a letter from immigration s/b a warning sign that they are probably going to impose some kind of fine and/or deportation.

Have you received the letter as yet ?

Not yet. Just went there last 17Oct ...that 's why I'm wondering at first they told me to come back on 02Nov to p-up the visa then after I left (1-2 mins.), suddenly the officer called me up and asking me to come back and sad to say he change his mind and asking me to wait for a letter instead of coming back to p-up the visa.

I'm not thinking of deportation for my son....what I'm thinking is for myself co'z I am the sponsor and it's my responsibility.

What do you guys think is the penalty/fine for this kind of case?

Am i missing something? non chinese born here ( HK ) parent is a PR and child is less than 21? check schedule 1 of cap. 115. That might help.

Thanks for all the advise...really appreciate it..

I received a call from the immigration yesterday and informing me that my son's visa is ready for pick up anytime. Thank's GOD...no penalty/fine or whatsoever.

My wife just picked up the visa this morning.

Again..thanks to all of you....
