Child Support

My helper has just given birth to a baby and the father is an expat in Hong Kong. The child was born in Hong Kong and now returned to the Philipinnes. The father takes zero acceptance and will not help financially. Does my helper have any rights to get child support from the father? If so, how to go about getting this? Thanks!

How can you prove that he is the biological father? As the plaintiff, the kid has to prove it.

Your helper has the right to claim maintenance for the child from the father. In the first place she has to prove that the expert is the father in that she has had a relationship with him which resulted in the birth of the child. As he is refusing to accept paternity she may claim maintenance under section 10 of the Guardianship of Minors Ordinance (Cap 13). The helper may seek legal aid to pursue her claim in court. Before resorting to making a legal claim it is best that she sends him a registered letter ( if not done already) by herself or through a firm of solicitors, setting out in full details as to why she claims that the expat is the father of her child. This may, in all probability, cause him to state his position in writing, which will be useful to pursue the claim.
