Legal Question?

The new flyover in Causeway Bay has been completed and some of you may have seen a newspaper report about the dangerous pedestrian crossing on it. I drove down that flyover the day it opened with workers frantically painting yellow warning strips on it to get drivers to slow down. Two years in the construction and on the day its opens, they are doing this as an after thought!


The Roads/Transport? Dept say its safe but I think its inevitable that someone will be injured or killed on it. Given that the relevent department has been given notice by a large number of people about its danger what's the legal position when (not if) someone is hurt? Can they be held responsible? Is there there such a thing as a charge of involuntary manslaughter in HK?


I know that in many countries if a business/person is made aware that something they own/operate is dangerous and they ignore that warning and someone gets hurt/killed they can be held legally responsible.
