Medical complaint - Medical report with lies

Hi, I have been pursuing a claim against a healthcare practice due to a condition I suffered due to their treatment, lack of advice.


This was referred to Hong Kong Medical Council by the practice who appointed a lawyer to check on this. I received a response which basically said that they were not responsible. (from here, I've added information which came up later since I posted) We received a copy of the medical report which was written by the doctor to the lawyer to support his investigation. But having read the report it's not accurate and he made up many more things that didn't happen.


Also, the medical centre has failed to give the standards of service, one would expect of a professional organisation. But I'm not sure if I can bring this complaint to Medical Council with the matter of doctor's liabilities.


I would like to consider more options in pursuing this. Can anyone advise of anyone who can provide consumer protection/legal advice with regard to the above situation.

I had a similar situation over a decade ago (in Hong Kong). A very well known paediatric practice incorrectly administered a vaccination for my son and covered up what had happened (at the time of the incident) despite my questioning. Basically there was a cavalier attitude from the practice managers and all the paediatricians within it. I made sure that I received copies of their "incident" reports and I had also documented evidence in my sons records (I had a copy of these so I could clearly point out where they had "changed" their transcript). My stumbling block back then was the lack of a medicolegal practice in Hong Kong. In any other country there would be a specialist lawyer that can look into medical legal incidents and mis adventures and review the evidence to see if you have a case.

I am not sure if the situation has changed. I would suggest you try and find a practice (if possible) that handles medical legal misadventure and then see what ground you have. If you go to the medical board on your own (even if you have medical training and knowledge of the long term sequale of your incident) you will have a difficult time. Good luck there should be far more accountability and reputation alone should not allow misadventures to be swept under the carpet.

Thanks for your reply and advice. We had planned to go to the medical council although was also looking at lawyers to see about an initial consultation as well. I feel very let down by the practice and doctor and feel reluctant to let them sweep this under the carpet. We arrived in Hong kong fairly recently so do not know the procedures etc. over here, but it has been very difficult to have to deal with this. Thank you again for your advice.

How is your case now? I have similar experience. I have consulted many solicitors in HK and I was told most of the solicitors specialized in medicolegal issues work for doctors. I wrote to medical council but it has been over 14 months and it was still in stage 1 (initial screening).


Did you write to medical council? How was your experience?


I would like to know more cases of patients encountering difficulties with medicolegal issues. I am prepared to raise public interest to raise the issue. I hope to find paitents who had challenges, to let HKSAR know that HK patients are so volunarable. I hope someday there will be mechnism set up to help patients like us.
