Divorce and Residency

I am a working resident on a dependent visa (married to a Hong Kong citizen). We have an 8 year-old daughter.


I have not gotten my permanent residency yet.


My divorce will be finalized before I get my residency.


A) Does my visa expire with the divorce, or does the original expiry date apply?

B) Can I renew my dependent visa if my ex- sponsors me?

C) Do I have any rights as a father to stay?

(A) Under normal circumstances your DV would expire when you are no longer a dependant. But there's probably some sort of grace period for cases like this.

(B) Don't think so - because you would NOT be a dependant.

(C) Not sure, but don't think so.

Best bet would be to ask the Immigration Dept direct. I have always found them to be very helpful and prompt in their responses to my queries - either via email or by phone (see their website for details).
