as i understand it, the ex partner's permission is no longer necessary to divorce after 5 yrs of separation. can anyone confirm if this applies if there are children involved

You have to satisfy the Court that the marriage has broken down irretrievably. This would be the case if you and your spouse have lived apart for a continuous period of at least 2 years immediately before filing for divorce and in such a case your spouse's consent to a divorce is not required.
What is required is an agreement for child custody which is done through a court order. You should see a lawyer if this is the case.
