Returning after a yr Posted by purefit (69 days ago) Our friends are returning to Hk after being away for a yr. Prior to leaving they lived in HK for 3 and half yrs, while their visa to stay in HK was still valid they had to leave HK for a yr. On returning back they have had to apply for the visa to stay here all over again (despite the old one being valid). So after another 2 and a half yrs can they apply for permanent residency or the yr away cancels their eligibility for permanent residency? Find what you are after in our Hong Kong A-Z Directory  Posted by cara (69 days ago) nope, they have to have 'continuous residence' here... if they've been gone for a year, that would negate it. at least from my understanding. when you apply for PR, you need to provide proof of residence (like leases, tax forms etc) as well as your passport copies to show entries & exits.
Posted by purefit (69 days ago) somebody told me they can be lenient and might make exceptions if ppl have been away only for a yr and the visa was still valid... Posted by cara (69 days ago) best to call an immig consultant. i have not known many gov't depts, let alone immigration, to be "lenient" when interpretting the law. |
