Under the Hong Kong Immigration Ordinance, It is a criminal offence to employ any one in Hong Kong who does not hold a Hong Kong Permanent Identity Card, or a visa issued to them by the Hong Kong Immigration Department that states they are allowed to work for you. If an employer enters into a contract of employment with someone who does not hold a Hong Kong Permanent Identity Card or a suitable visa, both the employer and employee may be prosecuted under the Immigration Ordinance. If convicted, this will usually lead to terms of imprisonment for both parties. AsiaXPAT does NOT screen the residency status of anyone advertising for part-time work on this site. Potential employers should always check the HKID card status of any potential employee, or support their application for a working visa before entering into an employment contract with them.
