How to get back a deposit

I have just vacated a flat after 14 months occupation. The landlords brother (owner is in Canada) wants to deduct HK$2,000 from the 25K deposit for marks on the wall. In my opinion the marks represent wear and tear, some mould and discoloration (one of these marks is 6 feet up the wall above the curtains). The flat was not in exactly great condition when we moved in. I have agreed to wash the walls down but he is expecting me to repaint.


I get the feeling this guy is just trying it on. Should he refuse to refund the whole deposit am I obliged to return the keys or should I hold onto them. Has anybody else had similar experiences, is there a Govt. arbitration service available?

From the way you describe it, it does sound like fair wear & tear, however, the only way you can proceed with a claim is to go to either small claims court or the lands tribunal, however it's a procedure that requires some time and paperwork.

try to talk to the landlord's brother again in nice matter and try to resolve it between you two before going into that whole procedure.
