Hiring a break contract helper

Hello,

I am planning to hire a helper that has had her employment contract cut short due to her employer's own family medical issue (break contract).

She was a direct hire from the Phillipines through an agency. Now that I wish to hire her, will I need to use the agency that she was originally hired from or can I choose my own agency to process the paper work?
