Private Investigator

ORIGINAL POST

I'm 99% sure my husband is cheating. I'm over it and basically I've had enough and want the proof to move the divorce along.

Anyone know any private investigators in HK who can do this type of thing?

I am not sure infidelity is required for a HK divorce... and it will have very little or no bearing on the propety settlement. Suggest you consult with a lawyer.

Actually adultery is one of the main criteria for divorce in HK. Check out the HK judiciary website. I am pretty sure if you actually have proof (such as a picture or video) of your partner's infidelity it will be more than enough for the judge to rule in your favour.

Sorry, I do not know any private investigators in HK but I do know that you get what you pay for and they arent cheap. Good luck!

Cheating is definitely grounds for divorce in HK, that was the basis of my divorce a couple of years ago.

I used a private investigator to get pictures of my ****** **** of a husband with some young local girl he was having an affair with. It wasn't cheap but it was well worth it. The investigator I used also tracked down some of the assets he had hidden away. The judge awarded me 40% of the assets, and it was basically all down to the pictures.

Folks,

let's be precise before this person spends a lot of money. Yes, cheating is one ground, however, as I wrote, it's not required. There are other grounds that may be easier/more cost effective to prove. On the other hand, there may be some satisfaction in getting the photos, and it may shorten the waiting time.

This is what the Judiciary says -

http://www.judiciary.gov.hk/en/crt_services/pphlt/html/divorce.htm#3

The court will accept one or more of the following grounds as proof:

+ that your spouse has committed adultery and that you find it intolerable to live with him / her

+ that your spouse has behaved in such a way that you cannot be reasonably expected to live with him / her

+ that you and your spouse have lived apart for a continuous period of at least 1 year before filing the petition and that he / she agrees to a divorce

+ that you and your spouse have lived apart for a continuous period of at least 2 years before filing the petition (in such a case your spouse's consent to a divorce is not required)

+ that your spouse has deserted you for a continuous period of at least 1 year before filing the petition

by the way -

I too am fascinated by the photographs - what exactly did they show ?

Yes I've been through this with a lawyer and it seems that unless you want a drawn out legal battle, the best thing to do is spend the cash and get pictures.

The only two options, since we haven't been living apart, are:

+ that your spouse has committed adultery and that you find it intolerable to live with him / her

+ that your spouse has behaved in such a way that you cannot be reasonably expected to live with him / her

The lawyer says that between the lines, this means the only acceptable reasons are if he has abused me (he hasn't), or if he has cheated and he admits it or there is proof.

There are other ways apart from pictures but it generally ends up as a "he said she said" kind of thing if you don't have pictures.

According to my legal advisor the pictures just need to show he is "close and intimate" with someone else and there is "reasonable grounds" to believe he is cheating. E.g. pictures of him with the same woman in different locations, being close together or holding hands, etc. Something that demands an explanation.

Shelly, do you still have the details of the investigator you used? Thanks

Malka, he will definitely try to keep as much of our assets as possible.

Shelly, thanks, what is a pm though?

I spoke to quite a few investigators so far (like, all the self-promoting ones on these message boards and the ones that come up in google) and they either don't have a clue, sound really scummy, or only do corporate stuff. It's good to hear someone has actually gone through this successfully, seems impossible so far.

I also want the details of this one, I'm in a similar situation, its really hard to find an investigator who I feel comfortable with, I always felt like I had to check that nothing went missing out of my handbag while I was talking with them

Miffus: I sent the details to your asia expat inbox, that's what a PM is. I don't want to put the details directly here but you can google for them the company was called grosner, it's a european company or something but the guy who got the pictures for me was from Isreal or somewhere, anyway hopefully they are still around, this was a couple of years ago.

I went to quite a few of them at the time, most were local investigators who quite frankly have no idea when it comes to investigating someone who isn't a local. Apart from that, all of them just remind me of used car salesmen, the guys I used actually had qualifications and know what they are doing. I can only suggest that whoever you use, look on their website and see who their staff actually are and what qualifications they have - if they don't want to give their names and qualifications on their website then it means something must be wrong

I found them and they seemed very professional (much more so than the others I talked to). They seem to do more of the corporate issues and stuff for the HK police but they have agreed to do a preliminary look into my situation and let me know in the next few days if they will accept the case. Hoping for the best!
