Job Objective

To manage DBS HK's legal, regulatory and compliance risks arising from the activities of, and operations undertaken by Support Units. To assist DBS HK to comply with applicable laws and regulations in its activities not covered by specific Business Units. To assist DBS HK's Data Protection Officer.

Responsibilities
  • Provide legal and compliance support to Support Units, including:
    • participate in and provide critical risk assessment of transactions, structures and new initiatives and projects proposed by Support Units
    • review and advise on agreements with DBS HK's counterparties
    • review and advise on regulatory or quasi-regulatory inquiries handled by Support Units
    • work with Support Units to develop and maintain standard documentation templates
    • work with Support Units, where necessary, to develop and issue procedures, guidelines and self-help tools on specific matters to manage legal and compliance risks
    • manage key litigation by and against DBS HK involving Support Units
    • work with Group Legal & Compliance supporting Support Units on any regional projects and initiatives and intellectual property matters; and
    • act as point of escalation for any material legal issues concerning Support Units
For DBS HK and its group companies in HK:
  • To manage DBS HK's relationships with external law firms to ensure high quality, practical and succinct advice in a timely and cost-effective manner.
  • To manage risks arising from personal data privacy matters, including enquiries, complaints, and reporting.
  • Advise on FATCA/CRS and any other regulatory reporting or regulatory matters.
  • To represent DBS HK in industry committees and meetings where required.
  • Review and advise on existing/new laws & regulations affecting DBS HK, including intellectual property.
  • Provide education and training on key legal & regulatory matters
  • Assist to establish house-views on Hong Kong legal & regulatory matters affecting DBS HK
  • Enhance Support Units' legal, regulatory and compliance risk awareness
  • Prepare valid and legally binding documents correctly reflecting the rights and obligations intended, and within risk acceptance thresholds for Support Units
  • Strong internal relationships, acting as a professional and value-adding partner
  • Effective litigation management
  • Timely escalation of significant legal & regulatory developments, incidents and concerns to relevant parties and proactively finding and developing solutions
  • Handle any regulatory reporting or regulatory audits in respect of Support Units
  • Maintain good team spirit and working relationship within LCS team
Requirements
  • A law degree from a common law jurisdiction is required, with a preference for Hong Kong qualified lawyer
  • At least 8-15 years of relevant legal experience in the finance, banking, or payment industry, or private practice
  • Ability to develop a rapport with business units and Support Units but maintaining independence
  • Good business focus with insight, innovation and the ability to balance risk and control
  • Good interpersonal skills and a good team player who can work with business units and Support Units
  • Good sense of ownership
  • Good knowledge of relevant banking, securities and other financial services related laws or regulations and operations (such as FATCA/CRS), and data privacy laws
  • Good leadership skills to foster risk awareness culture in Support Units
  • Excellent people management and communication skills and presentation skills
  • Proficiency in English and Chinese language skills (spoken and written)
