Ending contract early - logisitics help please....

My helper will be going to Canada in a couple of months so we will need to end her contract early.


1) When do we tell the Hong Kong Immigration, and how do we tell them? Do we complete a form, and can it be mailed or do we need to do it in person?


2) My helper wants to go back to the Philippines and then come back to HK and leave from here. I am okay to end her contract after she is back from the Philippines, since without the contract she has no way to come back to Hk.


Is there any procedure I need to follow so that I post-date the last day of her contract/employment?

Thanks for the update.


1) So basically I have to deliver the termination letter in person to the Immigration Dept? Can I have someone do it on my behalf?


Do I only need to submit a letter? No other paperwork needed at all?


2) What undue risk would there be - would be grateful for any advice. Do you mean the Immigration Dept might catch on?

Thanks Green Valleys. So basically I can just type up 2 letters - one from helper to immigration, one from me to immigration, stating the effective termination date. And then we can just fax both and have both personally delivered to immigration by a third party (if need be)?

Sorry to hijack your thread but I have a similar situation or maybe its not so similar! I note the above comments, however:


My helper wants to quit which is fine by me. She gave me notice but wants her last date to be first week in March. In this instance, can I send a letter to Immigration now telling them she is quitting and her last day will be, let;s say 6 March (bearing in mind this is over 1 month notice) but in the meantime if my other helper wishes to start can I ask the current one to leave earlier?


This is the first time I've dealt with a resignation and a new hire so any advice would be appreciated.
