What is the new DH wages? When does the $100 wage increase comes into affect? then $3580, now $3680?

I wonder if current helpers will end there contracts so they get the wage increase the way employers have fired helpers to benefit from the Levy?

Unless that's a typo, you are paying her less than minimum wage. What you are doing is criminal, not to mention morally reprehensible.



From the Immigration Department's FDH guide:


"Q3.1

Can I agree with my helper to pay lesser amount of wages than the minimum allowable wage (MAW)? What is the prevailing MAW?

A

No, an employer cannot agree with the helper to pay lesser amount of wages than the minimum allowable wage. Approval for the importationof foreign domestic helper is based on facts submitted to the Director of Immigration, whereby the employer has agreed to pay not less than the minimum allowable wage. An employer who underpays wages as stated in the standard employment contract is liable, upon conviction, to a maximum fine of HK$350,000 and three years’imprisonment. The employer would also be committing seriousoffences of making false representation to an Immigration Officer and conspiracy to defraud. Any person convicted of making false representation is liable to a maximum fine of $150,000 and imprisonment for 14 years. Any person convicted of the offence of conspiracy to defraud is liable to imprisonment for 14 years."

she may not be so happy when she leaves your employment and may take you to tribunal over it. Although i can't help but feel this has just been put in to stir things up.

Actually, I just thought about it, and it's not that you're a particularly bad person (as far as I know) although if your helper is looking after your children you are teaching them that breaking the law and exploiting other people is fine, which I wouldn't want my own children to grow up believing, but the system is wrong. Also, if she really does resent it, deep down, takes it out on your kiddies later, and then tells you the reason, it will of course be on your conscience forever. BUT, if this was a fair society, which did not condone racial discrimination, then after 7 years a helper would be able to become a permanent resident, and do any job she wanted. She should be able therefore to work for those 7 years for whatever pay she thought acceptable. But the government's own system says this is not allowed (and as DH visas only go to certain nationalities there is no question that the policy is racist), and therefore they must get at least some sort of protection.

But of course it is blatantly racial discrimination. Can my sister from the UK come here to live on a DH visa? No, she cannot. Or my husband's sister from the mainland? No.

The vast majority of PR Filipinas here are (or were) married to a PR and that's how they got the visa. As only certain nationalities ( and therefore in effect, races) can work on a DH visa, and this is the only type of visa where years in HK don't count towards PR status then of course it is racist. How can it be anything else?
