ORIGINAL POST

Can anyone tell me if I have to pay for a 1 way ticket for my new helper from the Philiphines to Hong Kong. My helper is leaving a chinese family, in Hong Kong to come and work for me. She mentioned that she is entitled to a one way ticket from her previous employer and that I have to pay for return leg back to Hong Kong??

Also she said that she is also entitled to 15 days paid holiday leave. Is this something in the contract?? She wants to take her return trip to the Philiphines a couple of months after she starts. I dont mind if it is all ligitimate.

Thanks

Someone else will be able to answer this better than I but here goes, anyway! I'm pretty sure helpers just get 7 days holiday/year for the first 2 years. At that time you pay for her trip home, and when she FINISHES her contract after 2 years, if you part ways, she is entitled to a one way ticket. I have never heard of what she's asking you to do, but maybe there is more to it?

I re-read your question, and wanted to mention that if Immigration is sending her back home for processing her Visa, then yes, you would need to pay for her return ticket to HK, but she is still not legally entitled to her holidays until she has worked for you one year, and then it is 7 days, airfare, and travel expenses. Hope this helps...

She seems really nice but I wanted to check all the fine details before she actually starts so I have my facts straight. Because we are new to all this I have a feeling that many xpats get told a few white lies by helpers

Amyvalentine is right in that you do have to pay for the one way trip from the Philippines to HK if she has to exit HK before starting work with you. However, she does NOT get any holiday until after she's worked for you for 1 year. She gets 7 days annual leave after 1 year of service, and another 7 days after completing the 2nd year. Some helpers don't take the first 7 days, but have 14 days at the end of contract. I'm not 100% about the return ticket bit, but I don't think you need to give her a return ticket to the Philippines at the end of the first year. You only need to get her a ticket to come to HK to work at the beginning, and then a one way ticket back to the Philippines at the end of the 2nd year.

All the legalities related to domestic helpers can be found on the HK Labour Department website (do a search - can't remember off the top of my head). It's got a very comprehensive explanation of everything most of us need to know.

You only have to give her one return ticket per contract, usually from PPines to here at the beginning and from HKG to PP at the end of the 2 years. Any flights home for holidays during the 2 years are up to her unless you want to pay. They are entitled to 7 days paid leave per year for the 1st 2 years, then it goes up 1 day a year for each year afterwards I think. They can have as much unpaid leave as you eant to give them.

My DH of one month just tried the same thing with me, now I'm having to figure out if her claim that I owe her a two week trip next month and 1/2 of her airfare is a misinterpretation on her part or the beginning of a pattern of dishonesty. I feel for DH's b/c they are pretty powerless at times, but I also get the feeling that some of them adopt a 'take or be taken' mentality that allows them to justify 'white lies'. Does the fact that both our helpers received 1/2 airfare from their prev. employers also mean that they lied to them and said they were NOT staying in HK in order to get the trip home paid for, or were they actually entitled to that regardless? It takes time to build trust and I'm not sure how I feel about her expecting a two week vacation after only 6 weeks of work...any thoughts??
