The only reason we wanted to hire a Chinese driver is because I heard that filipino drivers can only drive when it pertains to domestic duties. We need someone who can legally drive my husband to and from work.

As I understand it, Filipinos can drive your husband to work providing you are hiring them as a driver not as a domestic helper. The minimum wage is higher for a driver. If you hire as a domestic helper then they can only drive the kids as part of their helper duties.

cara you are right but what labber is trying to say is simple. i hope you will get the picture. for example, this one is true it happen just ayear ago, my husband who works here as a FDH, one night he ran into a police checkpoint with his boss in the backseat and he stop, so the police ask for his license and IDC , and so it was cleared and police told my husband they can go. Now if we are going to read the addendum for FDH it says that FDH are not allowed to drive their employer anywhere. If that so, why my husband don't have violation ticket or any kind when it happened. Here's the truth ,the Gov't simply create laws about FDH that makes very hard for them to impliment. It's absurd and way ..way out of line(for my own point of view) imagine, your the one paying their salary and yet you can't use their service but only your kids.

i been working here for almost 16 years doing as a family driver in my opinion and experience as a driver is they will not give you a penalty unless you drive without licence and you obey the traffic regulations here in hongkong.thanks mostly the complaint here about fdh drivers are from the taxi association and not from the immigration.

Agreed with Cara on this. An FDH cannot just drive. Permission must be given by the immigration department. ANY PERSONS driving without such permission WILL invalidate any insurance. This means if said person is involved in a traffic accident or, god forbid, kills someone then BOTH they and their employer will be liable. That could mean millions of dollars.

Secondly an FDH driver with immigration approval is allowed to drive most tasks, although driving an employer to and from a place of work is illegal. Once again, any insurance is invalid if such practices are taking place.

The police will not check with immigration on a simple stop (which are usually to look for ii's), but an accident will see both employer and FDH in court and fined, maybe jailed with a certain deportation for the FDH. Remember insurance is a must to drive, if you are responsible for invalidating that insurance it's down to you.

reply to cara and also evildeeds ,...LAW is a LAW you are right cara but illegal ? yah..maybe but in what way? because my husband have a valid HK licence and visa that states he can drive his" boss car" and also have a insurance for the car that he's driving which his name is on it & actually the driver in case accident happen, as far as i know, if your name is not stated on the car insurance as the driver of the car and accident occur you cannot claim anything. pls. correct me if i'm wrong cos this rings a bell to me and kinda worry me a bit. thanks guys...
