Helper's Holidays

Our new helper just started with us at the beginning of september straight after finishing her contract with her previous family. We needed her to start right away, because of work and travel commitments. She has asked me for time off around January and she's told me she would like at least 3 weeks off. I know she's entitled to only 2 weeks of leave per contract, but what happens when they defer their leave to come and work for you straight away, are they entitled to extra leave?

They're entitled to 2 weeks paid leave per contract, you can give them as much unpaid leave as you like.

ozcalgal, this is what my friend did. you can give her 3 weeks as she asked but because she is only entitle to 2 weeks, you can ask her to work for you on the public holidays and accumulate her public holidays into an extra week. it's fair and square that way. not sure if it's legal or not though.
