Long service

i have the case of a helper, she's been 9 years with her employer and following her to the US for the next 2 years. She is unlikely to stay with them afterwards.

When is she allowed to claim her long service ? She has signed a contract that will start as soon as she lands in the US.

Is her emaployer required to pay her long service now after 9 years? or in 2 years after 11 years, but knowing the US law does not requires it.... The hleper just want to be sure she is not going to have to forget about the long service by following them for 2 years overseas.

Correct me if I’m wrong, but once she is employed in US she is under US labour laws. They do not consider payment for a LTS in HK. She should claim the money now.

Yes, agree with Nuri. She should be paid in HK before she leaves for the US and begins the US contract.
