How do I go about terminating my helper

My helper has been with me for 4 yrs and this is her 5th year with us.Need to terminate her due to many reasons.


I have found another helper,who can join me only after a month,but needs to sign the contract immediately after which she goes for a month for her annual leave.


Do I keep my present helper and process the papers for a new helper or do I have to terminate my present helper immediately to process the papers for a new helper?

Do a search for 'terminate' on this forum and you will find a lot of opinions.


Essentially, you have two choices - either give one month notice, or give one month salary (and no notice). You also have to pay 100 HKD trapsortation fee and airline ticket as well as any leave days she has accrued.


In our case, our helper gave one month notice and she worked out her last month, but she has been with us many years and we trust her implicitly.


A friend had a really awful helper (dangerous to flat and baby. In her case, without going into details, it was really the best way to handle it:


She had all the paperwork in order.

She paid her all money owed.

She arranged and paid for a van to move her things.

She arranged and paid for a boarding house.

She bought her ticket.

She advised immigration via a termination letter.


Even the agency said she was more than fair in her case.

And as to the procedure, yes you can start the paperwork for the new helper while the old one is still under a contract with you. The Immigration will process the documents, grant her a visa, but will issue a visa sticker after you terminate the old helper.

Just to stress again DOCUMENT EVERYTHING CLEARLY... and make her SIGN something that says she received all the final payments, air ticket, etc... and KEEP RECEIPT of the air ticket and photocopies of all documents, etc... Just in case.

Nuri, do you mean, after I submit the termination letter to Immigration, I can apply for a new DH's visa? So essentially, I can seek for the last day of my current DH to coincide with the first day of a new DH?
