We are in the process of employing a new helper and are hoping for some clarity in what the situaton is in her having to go back to the Philippines. We are hoping to simply transfer her Visa from her current employer to us (they will release her). Is this possible without the need for her to go home? We have heard several different viewpoints on this so would be nice to know!

It depends on WHY she is leaving her current job.
If it is for certain reasons she does NOT need to return to the Phils immediately, for other reasons she does.
I don't know all the reasons, but here are some.
Can Stay:
Finished Contract
Employer Leaving HK
Financial Difficulties
Employer Died
Must Go:
Terminated
Resigned

...and either way I don't think her visa can be 'transferred' as it her contract number is quoted in the visa, and that contract is employer-specific. It might be purely academic, though.

Thanks, she is leaving because her employers wife and children are leaving HK but the actual employer will be staying for a few more months. Does this mean that if she has a release letter she will need to go back to the Philippines? Her contract would finish a couple of weeks after we want to employ her anyway (Long term contract) - do you think it would be better for her to just let her contract finish and then start for us and not need to go back?

We hired our helper under similar circumstances. I wrote a letter to the Immigration, requesting that she does not need to go back to the Philippines. Our request was granted.
