Letting helper go cos relocation

Hi all,


we are relocating overseas soon and need to let our great helper go before the end of her 2-yr contract. What are the laws governing such "terminations"? I want to place her with the next employer before we leave and with as little hassle to her as possible. Specifically,

(1) Can she work straightaway with the next employer without needing to return to Philipines and waste the 6-8 weeks (she has indicated she doesn't wish to go back)?

(2) Do I have to pay her severence pay and if so, how much?

(3) Do I owe her any annual leave?

(4) I have several friends interested to hire her what can I and my friend do to speed paperwork for her?

When this is the case, do you still have to pay for the flight back? (even though they are not going back)?


Also, how does the annual leave get calculated if the helper only worked for you for 6 months and 3 months (two helpers)?

Hi green, can I ask the exact procedure that you went through to "pass her on". Correct me if I am wrong:

(1) I (rather my husband) go to Immigration to obtain forms to fill, and submit a reason of termination letter. Hubby will leave HK first does he need to be present personally for release and signing?

(2) She submit her application forms with new employer at the same time?

(3) three week wait in which she is still under my employment?

(4) After visa approval, she works with new employer without need to exit the country (I will give her money equivalent of one way ticket instead)

1) you or your hubby dont need to go to the ID to do that, normally you just give your helper a release or termination letter stating there the date she started working with you and the day/date you releasing her.

2)The same time of what

3)Yes, normally 1 month or 3 weeks or 2 weeks you can start processing a new application or renew another contract

4)Some employer wants their new helper to deferred their leave and some employer they want the helper to take leave first.(for the ticket depends on the employer but giving her money instead of ticket is ok otherwise ticket will be useless specially if not refunded. i believed that those cheap ticket from Cebu pacific are not refundable.
