I sympathize your situation with your helper. However, a helper who isn't meeting your expectations is not a reason to skip the one month notice. Just like for your helper, she cannot just tell you today she quits and leaves without any notice or 1 month penalty salary to you.
Unfortunately it's the law, you want to leave right away, it must be with a termination letter (signed by her acknowledging the termination), a plane ticket to return to her homeland (including domestic flights/bus fare ), and 1 month notice or in lieu of 1 month notice, 1 month salary to her.
Have you ever asked her whether she wants to leave your household as you have been sensing lately how much "resentment" she has towards her job? Problems with DH often is due to mis-communication between employer and helper, or actually LACK of communication. (MOST of the time...) Sometimes, yes, the helper has got to go !
