Hello...I would like to hire a helper who is about to break her current contract. Does anyone know how to go about this correctly? I looked on the immigration web site but they don't seem to explain this. (Unless I'm missing it) She's planning on giving 1 months notice...Does this have to be done or could she quit out right? I would aprreciate any information.
Thanks so much,
SJ

i believe she can use holidays owed to her to take off some of the month she owes to her employer, but from my understanding, it is like resigning from any position. you give notice so you don't leave your employer in the lurch and give them time to find a new one.
unless she fears for her physical safety or she is being psychologically harmed in some way, i would recommend she gives the one month notice so she can get a reference letter that states she finished her contract and did not leave her employer in the lurch. future employers will find that important.
i know i didn't answer all your questions, but i hope this helps.

Hi SharJen,
I'm in the same situation and I believe the process is that if a helper breaks her contract willingly, she does have to return to the Philippines for three months, but then can return to start new employment.
If you find out how it really works please let me know.
Thanks

biareb,
she has to be in php for as long as it takes for her visa to be ready. thats anywhere between 30days-60days i believe. unless of course she gets denied.

Hi, We are also in this situation and wondering how you went about it - did you use an agency? can it be done yourself? is it easier/more efficient to use an agency? Ed, is this a service that the asia expat agency provides? if not, can someone recommend a good, honest agency? this person is lovely and would be a great "fit" with our family so we are prepared to make an effort, but financially we couldn't wait for more than 8 weeks. Any advice much appreciated, thanks!

Hiring a helper without an agency is simple. The contract is very straightforward - and usually the helper will take care of taking it to immigration and their consulate for the chops required and to pay the fees.
The ONLY thing agencies will do is in theory help with the screening process. But we are told that most of the agencies will find candidates from our site because most helpers done want to use an agency so they come to us. Therefore these outside agencies have no contact with the helpers - all they do is search our site and blindly recommend helpers to you (I think you can find more suitable helpers by browsing the helpers on our site... so these agencies really add 0 value).
On the other hand, our staff speaks with every one of the 600+ helpers who come through our office each month and they know which helpers are likely to be the best and the ones with the abilities that suit your needs.
The reason we set up an agency was because we were dismayed with the reports of cheating by many of the outside agencies. A common trick is to take advantage of helpers who are desperate for an employer - they will ask for more cash to get them interviews just before they are about to have to leave HK...
We charge employers less than any agency - we charge helpers NOTHING to line up the interviews and NOTHING if we find them a job.
If you must use agency services please contact Evelyn 2815 2520.

Thanks Ed,
Does that mean that she wouldn't have to go back to the Philippines for 3 months?
Also, can we start the application proceedings as soon as she has informed her current employer, or do we have to wait until the month notice period is over and her contract is finished?
Thanks in advance
