Hi, can someone please clarify, my helper just started with me 2 weeks ago and I've been told by a few that she doesn't qualify for the CNY statutory holidays as she is new in her contract - is this correct? And how long before she does qualify for statutory hols?
I don't mind giving her the time off but it would be helpful if she didn't have it - can someone please advise?
Thanks

3 months I believe before she is eligible for statutory holidays. Information is on the immigration website

She is entitled to stat holidays from day one but within the first 3 months you do not have to pay her for them although i don't know many who don't. Meaning for 3 stat holidays you can deduct 3 days salary if your so wish, you cannot refuse her them though.

just check the labour dept website and this is what it says?
thanks
Q2. Are the statutory holidays with pay or without pay?
A2. An employee having been employed under a continuous contract for not less than 3 months is entitled to pay on statutory holidays.
