When to accept holidays - Termination?

I am concerned because my helper wants to go back to her country for her daughter's graduation in april.

She told me about that long time ago but she only knew the date recently, after we decided our own vacations.

So now she wants to be out the week before our vacations.... I tried to find someone to replace her during this additionnal week but it seems that I will not find anyone at at a decent cost for us... (and I need someone as we work both of us)

I already told us I was pessimistic for that because I know she will be disappointed...

What if she goes anyway? I think it will be a termination cause...

Anyway, recently we were not satisfied at all with her job:

- once my son was really sick when I left home a morning and there was no way to call her during this day to have news

- another day she forgot to pick up my son whereas I reminded her in the morning about the day schedule

- her housework is not very good even after several reminders...

I didn't write any letters, I don't know if I should have done any... (I only wrote a SMS to her after that and also add a discussion of course)

In case we want to terminate with her before the 2 years end, how should we do it? Are we supposed to give 'pertinent' written explanations? a signed one? What is the risk for us??

Do we have to pay a one month notice anyway? Can't we ask this month to be 'worked'?

Any advice is welcomed!!

Many thanks in advance,

Stephanie
