my helper needs to borrow 20k for some family prob in the phili. she says she will repay 1000/- per mth which will tk her to the end of her contract. what do i do? i dont want to lose her but at the same time its alot of money!!

I would not lend her any money. HK is full of stories of helpers never being able to pay back despite the best of intentions.

But what if she will terminate the contract prematurely? What if she ask to visit or take care of that problem personally and will ask to go "just for 1 week"?
Usually this amount of money is what they need for all the charges they need to pay for agencies and stuff. I suggest you either don't lend or make it 10k because "at the same time its alot of money!!"

But then if you don't she might have to go and borrow it off the market and that leads to another place.
There are so many "catch 22" when dealing with DH's issues. I believe it's based purely on luck.

It implies that your helper is GOOD! Also when she asked to borrow money from you, she actually is being honest about her situation. There are cases where this kind of honesty end up as dubious to some people. Well, if I was in your shoe, I would lend her just the half of what she asked from you and deduct a certain amount every month. At least, she would lessen her problem. Its kinda hard to work properly when you have loads of burdens.
You alone could observe wether your helper has the plan to terminate the contract early after you lent her the money. Of course she would start to make excuses for the reason of termination....TRUST is very much involve here.

i had a chat with her abt this and she said she will pay me back 2000/- per mth. we pay her 5k monthly. i told her i will loan her 10k and not 20k provided she gvs it to me in writing that she will pay me back 2000/- every mth.
however i have a question....is there a legal limit to the amount she can pay me back or is it mutual???
im not happy to do this however she is a good helper and does her job well and i dont want to lose her.
so yeah will keep my fingers crossed....but can someone help me with the monthly limit???

actaully since its a personal loan i dont think there is a limit and since you paying her 5k/mo she can comfortably live with 3k/mo.
the legal limt is 1/10 of her mothly but i think that only applies to when she has damaged something in the house (ie appliances or something along those lines)

That's a really important point. If I worked in an office I couldn't go to my boss and ask for a loan, for many reasons. It doesn't matter what personal problems I may need the money for.

$ 20 000 is a lot of money. I wouldn't risk it. Maybe $ 5000 and she can repay you $ 1000 every month.
I have had TOO much experience dealing with helpers like this. Good and bad helpers.
Many helpers are trying to go to Canada too, if they suddenly tell you they are quitting, what are you going to do to get your money. She tells you I really really don't have the money to pay you back, but I really have to go in 1 month. You can't take an arm or a leg as repayment could you ?
And, $ 20 000 is a lot, there really isn't any reason she needs this money in one lump sum, and expects to get it from you. Ask her what it really is for?
And you better make sure she isn't going to get it from loan companies... after she leaves, you will have a lot of phone calls, letters, faxes, prank calls, and even people coming to your door to collect her debts. This can happen even after she's gone for 6 months or more.

Helpers are in a slightly different situation from "us": we don't live with our employer and create some kind of intimacy with him/her. Some helpers get into terrible situations by borrowing from friends (who can turn into gossip fiends in the blink of an eye) or loan sharks. If she trusts you, she can borrow from you, have the repayment taken straight out of her salary and no one else will know.
That said, 20K is definitely too much for me.
For repayment, how about getting the debt agreement signed in the presence of an impartial witness, and setting repayment in such a way that you still pay her the legal minimum? That way, she can repay 10K within one year, and be allowed out of the territory for a holiday without the possibility of leaving debts behind (which can lead to temptation).
Then there's the Canada and pound of flesh issue, as pointed out by momof2, of course...

I thought so... My former helper was in debt w/ loan sharks who kept calling home and asking for her, and eventually told me she had borrowed money and couldn't pay back. I asked her what was the problem, she broke down in tears and said they even threatened her and beat her. So i offered to help her with the debt, and she said she still owed them 500$!!!

We settled the debt and the problem went away, but I said she should report them for beating her (she had witnesses), but she didn't want the trouble associated with it (witnesses wre DH, too, didn't want trouble either). I later found out it is illegal for a lender to inform the employer of an employee's debts situation... If I'd known that then, I would have reported the b*s*ds myself!!
As you say, greenvalleys, nobody takes action... sadly, that includes me!
Sorry, bunny, this is completely off your original post, but the injustice of it all just sickens me! Hope you find a solution to your dilemma

Wow, demelza. That's awful. I think there would be a sneaky way of getting the address somehow.
I have a suggestion for any other helpers who have given up their passports as guarantee. Go to the consulate and report it as missing. Last seen in tung chung, TST, wherever the loan shark is...no further details needed.
THen fill in the paper work and pay the fee and get a new passport. If there are threats of violence, report them to the police for harassment and get a retraining order...simple.
Or, to make it simple.....don't hand over your passport in the 1st place.
