I have interviewed 2 prospect DH candidates. DHA's contract has finished and her visa expires on 20 July and DHB was released a month early as her employers have relocated overseas and her visa expires 12 August. I like both of them as they both seem diligent and my kids have reacted positively to both, though I think I favour DHB. I understand that DH are allowed 2 weeks after their contracts have ended to find a new employer and get their visas sorted. So my question is how long would it take for the visas to get approved? would the DH need to return to their place of origin before commencing work with me (visa extension of some sort?)? would DHB be allowed to work for me straight away - say next week? would this be considered illegal even though she was released early? If getting DHB is too complicated, should I just hire DHA? my partner is fine with either as long as it is all legal and proper. as for the new levy arrangements, we are willing to sign up a contract and pay the first quarters levy.

My admittedly imperfect understanding is that it usually takes 6-10 weeks for all the red tape to be done. She cannot start before it is all sorted. Yes, it is illegal for her to start early.

You're still looking at 6-10 weeks but sure.

It is not necessary for her to return "home". The DH just needs to leave HK. Macau is fine for example.

I assumed DHB is finished Contract, DHB doesn't need to go back to her country.. if they released her 1 month early that consider finish contract....

may be a bit late but my 2 bit, in both cases, case A the DH has finished her contract and case B, considered exceptional case employer relocating DH can remain in hongkong and process her papers with new employer, however in case B, you will have to write a supporting to the immigration, but it will not be refused, as it is legitimate.
once the visa is approved normally the DH has to exit H/K after a year, this can normally be done by exiting either to Macau or Shenzen.
