Maid is missing!!!

We asked our maid to go for holiday this July because we are leaving for holiday in Europe as well, she suppose t be back on July 23 (she have a return ticket) thats 2 days before we come back in hongkong. We arrived last friday and she is not at home, the house is messy and dirty, we thought she just went out that day and maybe she thinking we will come back late at night so she go for day off or something. I tried to call her mobile but its unreachable, so waited......till late night, early this morning she is not back yet, I called in Philippines (got a number from a copy of her beneficiaries' list on her passport copy) and her family said that she is not there, and the last time she left and came back here. I went to the police station today to file a report and ask if they have any news about her, but nothing. I dont know what i feel, I'm angry and jetlag, how can she not just show up, and tell us she dont want to work anymore at least we dont worry anything.


anyway drafting a letter for immigration now, they sure know if she came back in hongkong or not.

Have you checked her room? Are all of her things gone? Are you sure she left and that she's safe? Do you suspect she may have come into trouble?


Dpn't be angry at her until you KNOW you have readon to be, she could be in trouble.

yeah I checked her things they are there, no news yet, for sure we will know from immigration the truth if she came back in hongkong or not, will see today

Immigration will NOT inform you if she is in HK or not due to privacy laws! You may never know where she is.

She may be in trouble and maybe not (hopefully the latter). I would cover yourself in case and check any missing items and if there are any inform the police (just because her things are there does not mean she has not taken yours). Now assuming you want to fire her you need to inform Immigration of when you consider the last day of her employment and state you have fired her due to not being available etc. Also you should send her a registered letter stating you believe she has broken her contract and that you have/will fire her and outlining what you believe you owe her - send it to her at your home but do not recieve it yourself, ask the Post Office later for confirmation it was undeliverable and keep a copy of the letter sent. Note that you must still pay her flight home, any outstanding salary etc as she can take you to the Employment Tribunal later if you don't pay. And if you don't want to fire her now be prepared in case things turn ugly (and you want to fire her later) and she makes claims that you never paid her, never gave her time off etc - it happens in a few cases and is a known way for unethical FDH to try to get additional money and/or extend their time in HK to allow more time to look for a job.

Immigration informed us yesterday afternoon that she is not in hongkong, they said she didnt arrived on the day she suppose to come, its their job to inform us becuase she is our helper, she have a contract with us and we applied her a working visa. Also the police helped with everything.


As you can see on my post she went home for holiday, i bought her a return ticket and basically I dont owe her anything, she got her salary for June when she went home, she went home last July 3, 2008 and suppose to be back last July 23, 2 days before we are back in hongkong, so the case here is she abandoned her contract, she didnt gave us any notice, so if ever she come back in Hongkong we will know becuase the police officer who called me yesterday they are also in contact with the immigration.


I checked the house, we are looking for any missing items, we havent find anything only for like 5 bottle of wines and some expensive spirits, but we dont care about those its just simple stuffs, but some of my friends mentioned to me that maybe she run away from someone whom she owes money maybe her friends, or she got loans from the financing agency and she dont want to pay. We will know that for sure in the next months.


I am trying to ask around here in our building if someone knows her, but most of them said they know her but they didnt talk to her much because they said she seems not interested to make friends in our estate, i know she have some friends in other places but I dont know how to contact them, I need to just keep trying to call in their home in Philippines, but they said she is not in there, and police also asked the name of the agency who process her visa.

Well at least you know. I'm suprised Immigration told you beacause from what I understand they often won't comment. I would still send the registered letter outlining you have paid salary etc - its only a few dollars to do and have someone maybe witness it as well? The Labour Department deal with contract issues of salary, holidays etc not the Immigration so they don't always think alike and the letter would be for them in case you get called later (most unlikely however). Even if she is in Philippines her family may not say so I'd give up on that and put the whole thing down to experience. Good luck with the next hire it can be hit-or-miss but there are many decent FDH out there.

yeah i know normally the immigration will not comment, but this is a different case she is our helper we need to know whats going on, and also they already guide us through what steps to be done, and I feel relieved for everything. The police department also called us and they said they contacted the immigration and they known that she didnt came back, because we filed a missing person report.


anyway everything is going well, and thanks a lot for all your inputs. I just feel relieved to know that she is not in HongKong and she is out of our responsibility now, immigration said they will just cut the visa, we will just need to write a termination letter due to no showing, and no honor of her contract.

normally if she is hidding or running away with some responsibility (SPECIALLY IF SHE IS RUNNING AWAY WITH SOME LOAN SHARK) the relatives in the Philippines won't tell you where she is, just make a declaration with the immigration that she went AWOL.

yeah we also hope so, because maids like her doesnt deserve to have a good employer, i dont know if they will allow her to come back here again or not, but my hubby said he wants to talk to immigration to get her black-listed in hongkong, I know we will be gone from hongkong in the next few years since we are expats here, but we will feel pity for the next employer who will hire her, so we are trying to get her banned from hongkong. There should be a department that protects employer for cases like this.

Agree with ldsllvn, perhaps you need to wait untill you know what happened before trying to have her black listed (not sure it's even possible) and preventing her getting another job. She may have a very good reason or may be in real trouble.
