My helper has just informed me this morning that although we renewed her contract in July and paid the full amount of levy due that we can claim some back. In order to do this we need to terminate and then re-hire her and the process to re hire would take a week and then we would be reimbursed some of the levy payments.
Is this correct?
We love our helper and don't want to do anything that would jeopardise her contract.

I have also heard this, although not sure about the reimbursement. My friend has paid the first installment only, and she thinks she may not get any of that back.

It is true. We looked into it and there is a special form you can fill out called Statement of Termination of Employment Contract for the Purpose of Advanced Contract Renewal.
My helper picked up all the paperwork from Immigration (it included all the information with the forms), then went to the Philippine Consulate to double check exactly what we had to do. It's all on the website as well. You need to fill out a new contract (green form) first and take that to Immigration. They will then give you a date to put on the Termination Contract and when you fill that out you extend the date given by Immigration by 3 days to allow for visa (this informatioin came directly from the Consulate). I suggest your helper go to the Consulate directly to make sure it is all clear to her and you.
But the short answer (after all that babble above) is yes, you do not have to pay any more levy. I'm not sure about reimbursement though (we paid in installments), you may wish to check that out. I quick phonecall to immigration will give you all the answers you need.

someome said that they wrote to immigrations saying they are going to terminate their helpers and re-hire them unless they are exempt from next paymend and Immigration came back to them saying they can stop paying! Worth a try - guess they cant be bothered with all that termination and re-hiring business. Am going to write a letter for one of mine helpers i think - still 9 mnths on her contract.

Idsllvn - I think the original poster paid the whole amount of HK$ 9.600 when the contract was signed - same as we did. In that case you won't get anything back. the penalty for being organized...

I heard from the agent that if I terminate before it ends, I need to get a ticket for her to go back home. And the immigration website says the helper is not required to leave HK under this levy situation as it is in general. Does she need to leave HK or not?
