Procedure how to terminate a helper

I know there is another thread asking almost the same question, but i heard that i can give a one month notice and i do not need to pay one months' salary, how do i go about it? I just need to give her air ticket and $100? She is with me for 2 months only, i won't go into details on why.


I just want to know if this procedure is possible. I plan to give letter first week of Nov., so she will be in Hk til first week of Dec. Can i apply for the new one now? and when should i inform immigration? Thanks.

If you give her one months notice, you still have to pay her at the end for that month worked as normal. If you give her notice effective immediately, you still pay her the one months pay in lieu of no notice time. Either way she gets the months wages.

Boss,

Apply now and tell in writing IMD the "exact last day" your present help will be with you.

I suggest you get an agency to help you with this one since you are in the middle of this, need another DH to process and yet IMD will be processing your paperwork for a new one.

IF you have hired a new DH who has been terminated for financial reason by her employer (the reason is in writing for the IMD) then you can start the new DH working for you immediately and no need to wait 6 weeks for IMDept.

Whatever you do,get all of the present day DHs payments of salary, air ticket and everything in writing!

BTW, if you somehow got a new DH ready to being working for you with a new visa,and it was still within the 30 days of the previous helper, you could let her go early without penalty Just give her whatever she is due for salary and notify IMD with the new date she has left your house!

Thank you everyone for your reply, know what to do now more or less.


CC, i did not know i can call FDH dept and they can give details over the phone, i usually just ask agency.


My new helper is in the Philippines, hopefully processing will be fast.

ensure that you have everything down in writing meaning if you are serving a termination notice. ensure that a reason why she is being terminated and that she acknowledges it and that she understands why she is being terminated.


there are some who are crafty and turn the situation around i.e. saying they were terminated unlawfully and/or make up some horror story against you.

it would also help if there was a witness around for the helper to acknowledge the letter, you want all bases covered i.e. you dont want your helper to go come back to you saying she was coerced into signing it

Just curious, Wiz Bang -- if we terminate our helper and give her either one month's notice or one month's pay in lieu, do we need to specify any particular reason for the termination?


Our helper is just not very good at doing the job, but I won't say she has misconduct or neglects her duties, etc. You know this happens in any kind of job, just a mediocre employee that bearly does the work but not quite satisfactory. We did spend a lot of time training her, but she just doesn't seem to be in the right industry for herself.


We are not in an urgent need to terminate her now, but if we come across someone really good we might replace her.


In this case, do we need to specify a reason for the termination in writing? If so, what would people suggest that we say? We certainly don't want to say too bad things about her which will surely affect her taking on another job.
