transfering employer-what forms are required

We are hoping to employ maid who came highly recommended, her employers are leaving Hong Kong, I know she will need a new contract- where do I obtain one from? also I've managed to download a transfer of employer form for Fills consulate, what else will I need? Thanks

Thankyou, that is really helpfull, in fact the lady we wish to hire came with all the froms today, we just need to get a medical organised now and she is willing to do the runners job, nice lady been in HK 24 yrs, looking froward to her living with us.

Here is what happened, her former employers have already left Hong Kong now, our prospective helper has been in a boarding house for nearly two weeks. Her last employer did not give her release paper until two days ago, by post, which I think she needed a month ago when they knew they were going to Singapore.

This would have given her more time for Immigration Processing etc As soon as we got the release paper I went along with her to wait in the endless q's at Imm. Office , she wa told to come back on21st nov, 3 weeks time, I thought at least we could offer her accomodation until then, but we have been told NO, by Imm. Office.

I feel awful having to leave her in a boarding house, but we dare not break any rules at this stage, I know that. But what do the authorities think about her being able to manage until 21st Nov. with any severence pay of her last employer she will have to pay boarding house fees and for her food.

Her last employers thought the world of her, but they should have notifiefied the authorities earlier than they did, then she wouldn't be in this mess, they were first time employers of a maid, and I'm absolutely sure they didn'e know the HK rules.

My husband and I are going to meet up with our prospective helper this week end and offer to give her assistance so that she is not on the 'bread line', until she can legally come to live with us, and work for us.

This is a salutory lesson to eany employers out there who have to terminate their maids contract early for exceptional reasons that they should let the authoriies know in plenty of time to prevent their maid ending up in a boarding house for weeks. We hope and pray that her papers will process asap, so that we can let her live with us.

Personally I would just let her move in - tell her to keep her it quiet and be discreet and you should be fine - millions of them move in and start working prior to the visa being processed -

Hi. Just wondering. Did your maid have to leave the country to wait in a boarding house? We are hiring a helper who is working for someone else. They need to terminate her for financial reasons, and will give the release paper soon, but can anyone tell me. Once you submit all the documents, does she have to leave the country to wait for the visa approval. Her contract with current employer has another year and a half on it, so does she have to go through all the medical and all of that again? any advice would be helpful. thanks,

Hi Katey Her last employers left Hk,and as soon as their furniture had gone she went into a boarding house in Peng Chau, although they told her verbally they were going they did not give her the release letter, it was posted and the first one got lost, the second one arrived4 weeks after the employer on the contract had left HK. The last employers should have also informed immigration.

This delayed our helper- to -be putting in the new forms at immigration by about 3 weeks. They (immig.) allowed her to stay in HK a further 3 weeks after she submitted the forms, until 21st Nov, altogether she will have been in a boarding house for 5-6 weeks by 21st. We did however get a medical done while we are waiting, good company to use if you are considering it is www.igoodlink.com they are very reasonable starting at hK$500, and thier insurance looks Ok too, we can't get insurance until a new work permit has been issued. The results of the medical were good and have been very reassuring to us. I just fell so sorry for this lady having to stay in a boarding house that long. I don't think her last employers purposfully overlooked things, as they were first time employers of a maid,

If the lady you are thinking of employing has been released for financial reasons, her employers might like to contact immigration and find out what thier obligations to thier maid are, they can do that by email, new employer forms will have to be filled out, there are loads of them, the forms and the release letter taken to immigration, they'll tell you when to come back. If your helper to be is allowed to stay in HK while awaiting papers to be checked she must not leave HK to go eg. Macau or China otherwise her visa stay here will be invalid.
