My hleper sent a text to my husband to say she is leaving he is living in England and he signed her. I found out from her.
She started screaming at me that I am a liar and a nag and her other western employers never treated her so badly. I am so upset and shosked at how she is behaving particualy infront of my children who are only 4 & 5 and became very distressed at her screaming at me. She is leaving on the 26 Janauary but I would like her to leave immediatley as I am now very worried about her around my children but not sure if I can get rid of her immediatley as my husband signed her not me and he now lives in England as we are seperated. nNy advice please if I can get rid of her myself even though I did not sign her.

technically speaking, since you are not her employer - then she shouldn't be working in your house right?

Why don't you call up the labour dept. tomorrow and find out what to do. Since she's screaming with no respect for you and no concern for your children, you should ask her to leave the house immediately. Tell her to come back once you know whatever settlement is dued and remember to ask her to sign for everything.

1. She resigned - therefore she must terminate the contract. She needs to go into immigration and complete this.
2. She is in her rights to work out the month. But, you can give her one months pay in lieu of notice.
3. Ask her for an official letter stating her exact date of resignation.
4. Check with labor dept, they have an excellent checklist for working out what you owe her.

You can fire her, but you will need to get your husband's signature eventually.
You are required to give her either one month's notice or money that is the equal of one month's salary and she will get out immediately.
You will also need to give her any annual leave due.
One way ticket back home.
The Immigration require written notifiction which can be mailed or faxed stating the date she leaves your house and the reason you are letting her go. Because you are separated from your husband and he is now in UK, you will be the one to sign any new DH and will therefore need to show proof of income, address etc.
GET SIGNATURES on all money she receives and also signature on your release letter to HK IMD.

This guide can answer many of your questions, except the one about who signs the contract being the one who can fire. My opinion is that the Immigrations knows they onely need one signature for the contract, but the DH agreed to work for the wholel family, if you are unhappy, you have the right to terminate whether your husband is there or not.

Thank you all for our advise. I guess that she has resigned as she has sent my husband a text. I do not know what it said as he and I are seperated. If she has resigned then that changes things for me, right?

A resignation requires a termination/resignation letter which then has to be sent to the Immigration Department. I don't think they accept a SMS.

I got rid of her I got a witness who was the boss of the agency I used to sign the paper work. I came off very well by comparision to what some other s have forked out. As far as she was concerend even though we were sperated and he was back in the Uk and I am paying her wages he was her boss that bit she made very clear to me!!!!
