Employer redundancy

I will be redundant as of next month and want to assist my helper transition to a new employer. I will not be leaving HK for a couple of months, but cannot justify the expense, when my partner and I will be at home.


What is the legal position? We hear that she must go back to the Philipines and re-apply from there. Other people tell us differently.


Any advice appreciated - I have looked on the gov. website, but this type of situation is not described.

I have just taken on a Filipino helper who was already here. There will be a few weeks gap between when she ‘officially’ ends her last employment and when they authorise her working for us and give her another Visa. She saw immigration yesterday and they had no problem with her staying here in between. No mention of her going home. If the release paper from you has already been dated, signed and submitted, there is little you can do but help her find another suitable employer fast and hope she does not get kicked out. If you have not done a release paper for her yet, then it is up to you what date you put on that for her. They will give her a couple of weeks grace to stay in the country after the date on her release paper. No more than that, from the advice I got from an agency. Losing your job and not being able to pay her any more is outside of your control, BUT the date you CHOOSE put on the form is in your control......you see? Maybe think about only doing a letter once she has found another employer (should not take long if you give her a reference and help her get another job).

I have been looking for a good helper for sometime now,if your helper has not found a new employer as yet i would gladly employ her as i need one to start with me immediately(but would like to know her details ofcourse!) and if u would reccommend her......

I need to know, under what circumstances can the Dom Helper continue to stay in Hkg, when signing a new contract with a new employer?

if the helper finished her previous contract,


if she her previous contract was terminated with the reasons of

.. employer's death

.. employer's immigration to other country (should be supported with documents)

.. employers' financial problems (shoud be stated in the notice of termination)


then the helper can await for her visa while in hongkong and work for the new employer. She must exit after 1 year though because immigration give 1 yr visa for such cases.
