How to apply for legally live out DH??

We want to apply to immigration for a special permission to have our DH live out legally due to lack of space..I know that can be done and is granted under "special conditions". She basically will have to live on the sofa as we have no other space in a tiny flat so I feel this is a valid reason. People have done this before I know it can be done. Has anyone done this here and can help me with how to apply (to whom, what to ask, what to state etc etc). thank you. Pls, no advice on live out or not, just if you've done this and can help. thanks again

Basically you cannot, unless there are extremely exceptional circumstances then lack of space will not count. When you applied for a FDH you would have listed how many rooms are in your house, if immigration have processed the visa then they will be happy with that arrangement.


Since 2003 the amount of agreed live out arrangements that immigration have granted coulc probably be counted on your fingers. Most people go the illegal route.

Evildeeds - what constitutes extremely exceptional circumstances?


Like mixeymum, i am very keen to hear from people who have applied successfully. Your argument re: no. of rooms etc does not stack up. Many people have had no choice but to downsize in recent times and the space they had when the DH visa was processed is not necessarily the space they have now.


I have recently corresponded with immigration via email asking them to allow a live out helper on the basis of our new place having no space and they basically said bugger off, you know the score and read the legislation.


When I suggested that their extremely helpful advice left me with no choice but to terminate my helpers contract because I cannot provide her with the minimum requirements agreed in her employment contract they said, and I quote....


"We fully understand your situation but regret that, in view of the prevailing policy, we cannot accede to the live-out arrangement of the foreign domestic helper.

Thank you for bringing the matter to our attention."


So, like Mixeymum, i would love to hear from anyone who has had success, given my approach was clearly the wrong one, and on what basis?

Heh. Good point. Not to defend the sometimes awful quarters, but most of these ladies might have shared such a small room in their own homes. They are small in Western eyes, but not always in helper eyes. Also, a small room can be made quite cozy with some decent furnishings.

So how does someone go about 'hiring someone local??' I would LOVE to know. Have posted numerous ads on A Xpt looking for legal full/part time helper. Have been totally and utterly SCREWED over and taken to the cleaners by our 1st and last filippina dh. YES i know they are not all the same. When youve been the the hell on earth she put us thru you would understand.
