Maid for 2 weeks?

ORIGINAL POST
Posted by SandS 15 yrs ago
I am looking for a maid who could look after two kids end of July/Beginning of August. It is only for 2 weeks. I know that a lot of expats are out of the country that time, is it possible to lend out a maid for 2 weeks? It would be not-live-in.

Apart from that I am looking for a cleaner for once or twice a week.

Any ideas or agencies who could assist?

I suggest you use a cleaning service (Sparkle Maids?) for your cleaning requirements.

As for your chld care needs, Green Vallys states the genral position but i wonder, as your need is so short term, whether the following might apply (from FAQ):

Q33: My children's classmates live in the neighbourhood. Sometimes, if their mothers/FDHs are busy, I will ask my FDH to take them to school. Does it infringe the law?

A33:

An employer should not require or allow the FDH to work for any other person and the FDH has no contractual obligation to follow an instruction of helping a neighbour. However, given the said circumstances and the nature of the said assistance, if offered out of volition and good will of the FDH to a neighbour, it does not warrant intervention of the law enforcement agencies.

It seems, that if you know a friendly FDH, she can help out (with both cleaning and child care) on an ad hoc, occasional basis without infringement.

you might be right, GreenValleys - then again, you might be wrong! The truth is that we will probably never know whether this work could be done by a FDH without "intervention of the law enforcement agencies".

My point is that the question/answer indicates that FDHs can do ad hoc, occasional work for others, depending on the particular circumstances and nature of the assistance, and if offered out of the volition and good will of the FDH.

In this case, i think that it is at least arguable that the "good neighbour" FDH could help out.

In the unlikely event that the law enforcement agencies find out about this work and prosecute, the employer (and FDH) could argue that he/she reasonably thought that this type of work was permitted because it is a one-off, short term help. If you are right (and this interpretation is too liberal) i would not expect the consequences to be too severe - most likely a rap over the knuckles and told not to do it again!

In other words, there is some doubt about how the law works in this situation and no reason to assume the stricter interpretation is correct.
