how to inform immigration - break contract

Hi,


My helper will break contract with one month ahead written notice. How am i supposed to inform immigration? thru fax or i should go there directly? been surfing for contact number but can't find it.


When should i inform immigration? she will be here til sept 30 only. any info how to go thru termination is appreciated. thanks!

If your helper has written you notice, then scan it into your computer, go onto the immigration department Hong Kong websight, find the side column for Foreign domestic helpers, you should find an email contacting place in there, attach her resignation letter to it, adding from yourself the time her notice was handed in, they are very good at replying to emails, also print off a 'hard' copy and send it by post to the FDH section. Make sure you get acknowledgement from them. They should be informed within seven days of the helper resigning, or in the case of dismissal the same.

A registered letter is probably the best way unless you go in person.

make sure that you have a written letter from your helper that she is the one breaking the contract. otherwise- this could possibly boomerang back to you with tales of abuse or even employer maltreatment etc

The letter from your DH should state her reason for termination and your letter should state her last day of employment with you (so you are no longer responsible for her after that date). Mail both to the Immigration Dept and keep copies of both letters for your records.


On her last day, give her all her entitlements, write down what you have given her, both you and she to sign with a copy to her and you keep a copy, then bid her farewell!
