Long Service Payment

New experience to share.....my helper has worked for me just over 5 years. Today she asks me to lend her $10,000 as her own saving is not enough to pay for her father's operation. I trust her as she's a really good helper for all the years she's been with us so I said OK. Talked to my husband and he suggested that I should give her the long service payment in advance so that she doesn't have to repay month by month which will be hard on her as she has to support her parents and a son who is still studying. Our helper was so relieved and happy with our choice.


We pay our helper $4,000/month as soon as the levy was cancelled - just serving the 2 of us and no pet but we calculated the long service according to the monthly wage written on the contract......


3580 divided by 4 = 895

895 x 3 = 2685

2685 x 5 = 13,425


We gave her $13,425 in cash so that she can send home immediately, the amount more than she asks for and no repayment to worry about.


Just wanted to share this so that this is another option you can choose in case your helper needed genuine help.

This is a good option. Will keep in mind if ever my helper asks for loan. Our first contract will be ending soon and I think we will renew for the 2nd.

Not sure if this is a good option.I had a similar experience.Helper wanting me to advance her long service.I called the labor department and was advised against it.There is no such thing as an advanced payment of long service.It is due only when the helper leaves at the end of contract or on termination agreeable by both parties.At the end of the day if the helper demands the long sercive when she leaves you'll have to pay up as the labor department does not recognise the advancement.Just thought I'll share this with you.

Thanks for sharing but I've already given the money to my helper and I did ask her to sign for it. I told my helper about your concern and I've ask her to write a letter to me indicating her request which she willingly obliged. Guess this will protect me.

In addition to what I mentioned.Just like you I asked if I got a letter from the helper,would it cover me.The answer is 'NO'.THey go by the law and what transpire between you and your helper is just that.If there's any dispute,the law stands.You still have to pay the long service [in your case, again].How you get your money back is your problem not theirs.

From day one, I've always given her salary in cash and have never asked her to sign for anything. Everything was and is based on trust but of course she had to prove it in her work and behaviour in the beginning which she did and so far still going on strong & well. I hope (as cara pointed out) that one day when either one of us wish to terminate or finish off the last contract for whatever reason(s), things do not turn sour in the end.

I think my helper is not that kind of person who bites you if you treat her well and fair so I do not fore-see any dispute that needs to be settled and if my judgement is wrong, then it would be a very bad & hurting experience for me.

I think that using a long service payment rather than a loan is the best way to handle a request for a loan. It keeps everyone happy and fulfills the letter of the law also. Good idea and I hope it works out well for you!
