Have found a new helper but she tells me that as it was she who cut the contract with the employer, she may have to go home for 3-5 weeks. Is this correct or would immigration let her stay if I said I needed her urgently (as I do). The helper is more than happy NOT to have to leave the country.

The FDH will have to return to her own country or at least leave HK (she can go to Macau/China etc) until her visa is processed if she has not completed the contract, and if she has terminated. There are exceptions if the employer is deceased or employer terminated for financial problems. It takes 6-8 weeks minimum to get the visa. I tried to get a helper earlier than this with an urgent letter to Immigration and it took a total of 6 weeks. From my experience, Immigration does not make any 'special' circumstances no matter how desperate you are.

I employed my helper after she resigned from the previous employer. My experience is that this appears quite frowned upon by Immigration. After serving her 1 months notice she then returned to the Phils for 7 weeks. This was after my husbands PA who is Chinese hounded immigration constantly. So in total I waited 3 months before she started working for me..She definitely has to go home no question
