Empoyer withholding passport

I'm trying to get some info for a friend.


He employed a helper many years ago in HK then moved away and after moving back to HK has stayed in touch with the old helper whilst she's worked for other employers who are very hard on her. After 6 years with them and her contract coming to an end at the end of the month she's not renewing (she told hem a few months ago) and the employers are keeping her hostage and refusing to give her her passport. She wants to start the processing of her new work visa with the new employers now so that when she finishes with the currnt empoyers n the 1st of May, she can start straight away with the new ones but her employers say she can have her passport on the 1st of May.


I know this is illegal an my friend wants to see who he can call to get her some assistance. They are not at all concerned if the employers get in legal trouble after how hard they've been on her (6 years on minimum pay and 2 days off a month but she's only free after 10am and has to be back top make dinner so it's not a day off really).


What can he do??

Ask advice from her consulate and Immigration, they are not allowed to do this.

Definitely call Immigration and Labour. Nail those bastard employers to the wall.


There's also that advocacy organization whose name I forget. "Helpers for helpers" or something like that.

Should definitely be reported and a complaint filed.


However, I am not sure that having her passport at this time would help her to start processing her new visa. My understaninding is that she can't do that without a release letter, which obviously the current employers are not going to give until 01 May. So from that point of view she is stuck.

spurtio is correct. She cannot start processing without a release letter until the end of her contract.

These situations can become nasty quite quickly. Deal with it now, an employer who is prepared to ignore the legal rights of thier worker is not to be tolerated, report the passport retention and if necessary resign, the advice to contact the police and ensure that there is no grounds for false accusations is good advice.
