I need some advice, I'm about to process the papers for a FDH who will be having her current contract terminated as her employers are moving overseas. Does the FDH need to return to Philipinnes to wait for Visa or can she stay here whilst her papers are being processed? I read somewhere that FDH who are terminated need to go back home and need to apply via an agency - is this the case for FDH who has been terminated due to relocation? Where can I find information on this?

Under these circumstances the helper can stay in Hong Kong to be processed - the other two occassions (that I know of) that you can also process in Hong Kong are:

finished contract

Released due to Financial reasons

All other reasons they need to go home to be processed

I think the fDH will have to show a letter of termination due to moving overseas by her last employers which has to be hand written(not a photocopy) and signed for Imm to compare with their records. We had a siimlar situation with a helper, her last employers didn't write one, so we had to contact them in Singapore, which delayed things. In the end the helper was allowed to stay while papers were processed, but strictly forbidden to start work for us, or live in our house until all the paper work was completed, Now we will be terminating her before her contract expires, for reasons of her performance, and we will have to pay her air fare home, and also money in leui of an airfare into HK which we should have paid at the beginning of the contract. So from your point of veiw it might be just as easy to let her go to her country of origin, which her last employer is responsible for, then when she is ready to return-papers completed etc, you pay her airfare into HK, and any agency fees,
