A technical Q, re termination

Hi,

Under the Labour departments advice for termination of contract, they say employee may be entitled to severence payment, if they have been employed for NOT LESS THAN 24 months, does this mean if you terminate on the first contract, up to at 20 months, they are not entitled to severence payment?

Also as we can only verify some of the reasons for dismissal, we cannot prove 100% the thefts which have taken place, little bits of this and that, which she always denies. So would put reason for dismissal No longer required, because I intend to do the housework myself, which I would do as I don't intend to employ another FDH after the bad experience with this one. I would not like her to turn round and try to say she was unfairly dismissed, I just don't want the hastle

Correct. No severance ion the 20 month case.


You have to give notice of one month. That is after you terminate, she works for you a month (and you pay) or you just pay the month and she goes. In your case that is what you need to do.


You can still write no longer required. That's not a problem. If she argues (very unlikely) say that in that case you will terminate her for cause, leaving her without her one month notice.


On a side note, I don't think you should judge other helpers from the perspective of this one. The vast majority are hard working and honest. Just because one was bad doesn't mean the next one will be.

Theft is denied and always the helper argues there is no proof. ...

We are at work and of course cannot prove the theft - we do know that a Cartier pen or HK500 or a pair of earings is gone.... but how do we ever prove it.....

Too hard to prove and more annoyance than it is worth to pursue for that kid of value. I would suggest you walk away.


Yes, it is annoying. I can understand that you feel violated. There is always a risk with a new helper. However most helpers are good people.
