why my employer she don't want to give me a reference letter is this violation for a labor code here in HK or not , i work more than 12 hrs. he make me slave but now i want to leave her for some reason i find another job thats why i need a reference letter so if not give a reference letter may be much better t break a contract . can you give me advice .. please i have 1 year already working with her so i know that i have the right to break the contract.

- You have the right to break your contract at any time, not just after one year.
I'm afraid you'll have to make do without a reference letter. On the bright side, a reference letter from such an employer might not help much anyway.
Note that if you can stick it out to the end of your contract, your chances of finding a new job afterward increase dramatically. Many employers won't look at candidates with broken contracts.

you don't need a reference letter, you need a termination of contract. All you need to do is to give your employer 4 weeks notice and write a simple termination letter for her to sign to prove that the contract is no longer valid, so that you can start the new application process. If she does not do it, you can write a letter yourself saying the contract is broken. Nothing stop you from walking way if you give 4 weeks notice (or pay for it)

Your employer is not making you work against your will or denying you of your rights and I doubt having your services without compensating you is she? Therefore it's very unfair to call her your slave keeper. You undertake her employment with the conditions set and agreed, if it doesn't work out, then leave. She is under no obligation to provide you with a reference letter whatsoever, these are earned through mutual respect and in your case this is not forthcoming. Have you asked yourself why?
There are plenty of people in HK working the hours you work having to pay rent and food out of their own wages, which you don't have to. Life in HK is hard so get over it and stop whinging or just leave. You have that right, a slave does not.

I understand your predicament. You can';t for her to give you one if she do not want to.
Try asking your agent for help, or visit the embassy and ask for advice. Explain to them your situation.

110.136.196.6:80, for 12 years working with her how did you managed to work with her if you work like a slave..or you're just saying that becasue she doesn't wanna give you a reference letter that you need for your visa (Canada) i bet for 12 years you have a good relationship with your employer maybe when you first applied a work in canada you it is better to tell your employer about it so that she can support you with your decision, for your 12 years that you work with them i am sure they dont mine giving what you need..

alex, please re-read. she worked for a year, for 12 hours ( per day I assume)
On the other hand, your question made me think. I work with my boss whom I adore for almost 11 year but the 12-17 hours/day and sometimes 8 weeks no day off is starting to get to my old and weary bones ( j/k ).
