Helper work visa-clarify please?

Our helpers work visa expires before the end of her contract, her contract expires-and will not be renewed in November. Our helper got her passpport renewed in Sept 2010,

As we informed her in August that we will not be renewing her contract (we have had lots of problems with her), and told her to find a new job then, and also advertised her on our local web site with only a true appraisal of her work.We were willing to let her go early should she find another employer, which she hasn't!!

She does not want to work with small children or large dogs, and has not found another employer. She has had a very easy life with us an elderly couple with a small dog, and survived despite a lot of intollerable behaviour, which some employeres would have sacked her for.

While we were away in Europe on holiday, only returning yesterday, she tried to apply for a new work visa, on our return we found a letter from IMM, stating that my husband woulc have to go to Imm with an appointment to get a Visa, I have contacted them stating that we will not be employing her after her contract expires, I am wondering should my husband still have to go to Imm to renew her work visa? as we will not be employing her in the near future, or is it the responsibility of any new employer if she finds one.

How can she renew her work visa if your husband didnt sign any new contract with her?just wondering how she did(helper)that..

To answer your question, no, your husband does not need to renew her visa since you will not be renewing her contract. Her new employer (assuming she finds one) will be responsible for her visa application.


Your helper is a sly one, trying to pull off a renewal of her visa while you were away.

I think the helper is not being sly at all. She just did what should be done.

The contract is still in effect until Nov. The reason why her visa run out before the contract did was the need to renew her passport. Whether you sign for another contract or not is another story. And yes, she will need a supporting letter from her employer and the necessary visa fee for that, otherwise it will be considered as break-contract.

The thing is, she don't even have to go to the Immigration to have her new visa stamped on her passport--she could just get out of HK and come back, answer "yes" to the standard question for ID officer " Are you still working for Mr/Mrs So and So".


Please note that the work visa will only be extended to the duration of the contract.

Just found out that her Visa actually expires 23rd Oct, and the contract 24th November, didn't realise it was so soon!!, thought it was only a matter of a few days difference. Despite email Imm last Monday I have had not reply form them.
