If a DH is working part-time job on Sundays--for example in a pub--but the employer has no idea that she is doing so, can the employer still be in trouble? And if so, in what ways can the employer be liable if he had no idea of the part-time work? What could potentially happen to the employer?
The other baffling thing is: how can an employer do anything about preventing a DH from working part-time on her day off? It seems that even if a DH knows that she is not allowed to work part-time and she still goes ahead and does it secretively, then there isn't anything much an employer can do, is there?

You could tell your helper that you will not tolerate any part-time work she might sneak off to do, show her the rules on the HK Imm web sight.
If a helper 'sneaks' off to do extra work even in their spare time it is illegal, and if they had a bad accident in someone elses house, ie " falling off a ladder cleaning windows" they are not covered by their employers health insurance. Plus they could be out of action for a while to work in their employer house.

Telling her not to do it doesn't make you any less liable.
I didn't mean health insurance. I meant liability insurance for helpers. This is mandatory for all employers as part of helper insurance.

We think that our DH is working part-time in a pub on Sundays. We were thinking of changing her day off to Mondays so that there are probably less hours for her to work in a pub on Monday.
Is it mandatory that a DH must have Sunday off? Is the employer legally allowed to determine which day the DH takes off?

She will probably tell you she needs to go to church on a Sunday, and be reluctant to have another day off. Also most other FDH's are off on a Sunday as they like to congregate and meet their friends. I don't think the Sunday is a mandatory day off though.
Can't you check where you think she may be working, and surprise her- then tell her off. Or simply ask her straighforwardly is she working on a Sunday.
Tell her you dissaprove, re-inforce the reasons why, and she will be dismissed if she doesn't stop working where she is not supposed to, because it will be you and her who will get in trouble if found out, it worked with my Dh who thought she could do extra work.

You are allowed to decide the day off. It is not very nice to change it mid-contract without her agreement however.
Also it would be better to avoid such games as changing the day. If you play games, she has a justification for doing so. As Susie1 says, check first, then talk to her if needed. Be frank, open and honest even if she is not.

the best way is to ask the immigration department on what to do if you suspect your dh to work illegally in another workplace. just covers your a_ _ !
if you do find out that she is working in a pub or somewhere else, you could speak to the manager of that place.

How did you know that she is working PT there? maybe she goes there for fun only...i know a lot of filipino love to go in a bar to drink, dance and sing sometimes..

Can anyone actually cite a case where an employer was prosecuted on similar facts, i.e., where the helper was not directly ordered by the employer to work outside the home in family shop or a relative's home?
