Annual leave

Hi all,

Does a helper's annual leave accumulate? Reading this I would say no - its 7 days per 12m. And of course no carry over between contracts.

AFAIK it does not accumulate. However it can be deferred.

What does deferred mean in this situation? So take no days in first year and 14 in second?

I think deferred leave has to be negotiated between employee and employer within 60 days of the proposed date, ie if is agreed a statutory holiday is to be missed for some reason, then the day off is given within 60 days either side in lieu,(somewhere either in HK imm or Labour dept rules) I don't think it can be officially completely missed in the first year and all saved till the second year, and payment in lieu of a missed holiday is not allowed.

As Susie1 says, I don't think it can be deferred that far. A few months at most I suppose. Also it needs to be approved by Immigration if memory serves.


It cannot be replaced with money since, technically, the helper is not employed during the leave.
