Hi All,
We gave notice to our helper and her last day is Dec 10th 2011. She said she wants to fly back on 21st Dec which is so close to christmas day and ticket price is 1800hk$ to manilla and 900hks$ for her local fligh. The bus ride is 20 hours to her hometown and I am told by my agent that it would be very difficult for her to get a bus during that time.
Now i am in a dilema, we gave her 1 month notice starting 10th Nov and want to releaser her on 9th Dec (we are also flying out on 9th). now the total ticket cost is coming out to be 2700hk$.
In a normal time, it would be 600-800hk$. what shall I do. Shall I talk to her and convince her to fly on 14th-15th? the flight will be 1300hk$ and she may be able to get a bus to her hometown too.
Legally what I am responsible for. Can she chose the last date in HK (i think she obviously can). Am i Obliged to buy ticket or shall I just pay some money. Not trying to be unfair here but i really dont want to pay extar 1800hk$ here.

rs2000 This doesn't answer your question but you can always get a bus, but the issue is how long you must wait for the bus at the depot. Depending on where you are going, it can be 30 mins or 8 hours if you are leaving from the depot. If you at waiting on the route somewhere then I would say it's not possible. At that time of year the wait for the buses to most area's in Luzon takes about 3-4 hours. I have done it more times than I wish to remember and it is possible.

Your responsibility as employer is to provide an air ticket for her so that she can go home.
I would suggest for you to ask your helper to canvas for a ticket price on the day that she leaves your home, if she can't do that, you do it yourself. Then make a computation based on the airfare (e.g. Hkg-Mnl), plus airfare (Mnl-???), plus bus, plus meal allowance. Put this in a piece of paper and let her sign it (her having received cash instead of ticket/s).
If she wants to leave Hk on a different date, she must shoulder the difference. I mean, as employer you've shouldered your responsibility.

she is very lost and has asked me to book a ticket instead. Now when I asked her she initally said she wants to stay more to find employer. then I asked her if she would pay for extra herself. she said no and that she is fine to leave on 11-12th dec. Now if I pay fer cash, shall I pay it on her last date which is 8th Dec? but by then the tickets for 10-11th Dec will be quite expensive. or shall I pay her based on the calculation I do today (about the cost of the ticket).
or shall I just book the ticket and give it to her as she said verbally that she is fine with it. although there is not proof for it other than her verba consent. i am confused. please help. Thanks a lot!

Have a look now on the internet airline sites, for the dates she wants to fly, down load a copy of the web page with the price on and print it and keep it, you do not have to book the ticket at this stage. Give your helper the cash(based on what todays website of the cheapest airline says today) for the one way trip on the last day of her employment with you, with an independant witness present. and get her to sign for everything you have given her.
When my last dodgy helper went, I got her to sign for everything,with our lawyer next door neighbour present, then I copied and emailed the signed forms to IMM along with a copy of her air ticket, because we bought one to make sure she left HK when she should, I just 'double' checked anything with her as she was the type who could turn round and claim unfair dismissal, because she couldn't get another job.

Call Sally Travel 2522 5263 in Worldwide House. They will be able to tell you cost for the correct flight/bus for the day you want 11th or 12th. They can book it for you. You pay them and give her the voucher.
If she then decides to change the date then that is her problem not yours.
Just one point, make sure you know where she actually has to go to in the Philipines, because it may involve two flights, or flight and bus. There is a common assumption that a flight to Manila will suffice, when for many FDH Manila is the wrong end of the country and a world away from home. Again the team at Sally Travel will be able to help advise the best routing. (They have with me, anyway).
